Section 12 - Abatement of Violations
12.1 All Unit Owners and tenants, their family members, guests and employees are required to comply with all the rules and regulations which may be promulgated by EEFCC. They must likewise comply with the rules and regulations, ordinances and laws enforced by duly constituted local or national authorities regarding the use, occupancy and sanitation of condominium units.
12.2 In the event that any Unit Owner or his tenant or lessee fails or refuses to comply with any covenant or condition of the Master Deed, or with the Rules and Regulations in the Use, Enjoyment and Occupancy Units or property in the EEF premises within the time
fixed in the notice given to him by the Board of Directors, the Board or its duly authorized representatives, shall have the right to enjoin, abate or remedy the continuance of such breach or violation by appropriate legal proceedings.
12.3 The Board shall assess all expenses incurred in the abatement of the violation, including interests, costs and attorney’s fees, against the defaulting Unit Owner.
12.4 Unless otherwise specified by the Board of Directors or its authorized representatives by the due notice sent to the Unit Owner and/or tenant to his unit at Essensa East Forbes, the Unit Owner and/or tenant will be liable for all violations of the Master Deed with Declaration of Restrictions and all Rules and Regulations promulgated by the Board of Directors, committed by the Unit Owner or tenant personally, his family members, guests and employees. After the deadline or time fixed for the abatement of such violations and compliance with the pertinent provision under the Master Deed or Rules and Regulations, the Unit Owner and/or tenant will pay EEFCC liquidated consisting of:
12.4.1 A daily penalty which will accrue until such time that the Unit Owner and/or tenant has abated or corrected such violation and complied to the satisfaction of EEFCC, and
12.4.2 All expenses, including attorney’s fees, incurred by EEFCC for the enforcement of the provisions of the Master Deed with Declaration of Restrictions and the House Rules and Regulations.
