Section 3.0 Rules and Regulations During Construction Phase

3.1
The Condominium Corporation has the right to protect the building and its facilities and in this regard may post a guard at work area whenever it deems necessary; the cost of which shall be for the account of the Unit Owner’s Contractor.
3.2
Authorized entry and egress point to the building for the Contractors and its workers shall be at the Employees / Contractor’s Service Entrance. Contractors’ personnel are to proceed to their respective work areas using the route prescribed by the Administration Office.
3.3
Construction personnel of unit owners shall be allowed entry and access to the work only under the following conditions:
3.3.1
Submission, in duplicate, of a list of workers at least three days before actual construction work is to be done indicating the names and designations of the workers. Persons not listed will not be allowed to enter the building.

3.3.2
The workers must have a valid identification card which shall be surrendered to the security guard at the Ground Floor Parking Vehicle Entrance/Exit gate in exchange for the DUTY-ACCESS PASS (ODAP). The ODAP is to be returned to the security guard by the holder upon egress from the complex.

3.3.3 Loss and / or damaged ODAP shall be charged to concerned worker Php xxx.xx/card.

3.3.4
Prior to the issuance of the ODAP, the construction personnel shall be required to secure an ASSIGNMENT SLIP (AS) from the Administration Office. This AS, together with the valid ID card of the worker, shall be presented to the security guard in exchange for the ODAP.

3.3.5
For security and safety reasons, all Contractors’ personnel shall not be allowed to wear slippers and sando while in the building. Workers wearing such shall be refused entry or ejected from the premises.

3.4
Stay-ins are strictly prohibited and all Contractor’s personnel are subject to search prior to entry and departure to and from the building/premises.
3.5
Working hours shall be restricted to the following schedule:

MONDAYS TO FRIDAYS
8:00 a.m. to 12:00 n.n
1:00 p.m. to 5:00 p.m.

SATURDAYS
8:00 a.m. to 12:00 nn

No work of any kind shall be allowed outside the general working hours on weekdays, during weekends (Sunday) and Public Holidays.

Workmen are not allowed to enter or stay in The Essensa East Forbes during these hours.

The total duration of the renovation/construction must be relevant to the scope of work approved but shall in no event exceed a total of three (3) months from the date work has started.
3.6
The Service Elevators are the authorized conveyances for the Contractors personnel and materials. Use of the Passenger Elevators for these purposes is strictly prohibited. Contractor is to submit his schedule of items intended to be ferried on the elevator at least three (3) days before.
3.7
Contractor’s personnel are to restrict themselves to their respective work areas. Failure to comply with movement and restriction arrangements and regulations constitutes a s
security violation.

Violators may be subjected to detention and questioning by the Administration Office and its security agency elements.

Violators will be refused right of re-entry to the building
3.8
All construction materials, supplies, tools and equipment are to be checked prior to entry into the building. Contractors shall advise and submit a schedule of materials, tools and equipment in triplicate to the Administration Office at least three (3) days prior to delivery.
3.9
A Gate Pass Request (GPR), in letter form, from the Contractor, duly signed and approved by the Unit Owner or his authorized representative, shall be required and presented to the Administration Office for bringing out of items and/or articles from the building.
3.10
Other restrictions and prohibitions on construction personnel:
  • Drinking of any alcoholic beverages
  • Gambling
  • Taking Illegal Drugs
  • Indecent exposure or nudity
  • Horseplaying
  • Fighting
  • Carrying and any lethal weapon
  • Cooking of food
  • Vending
  • Bringing-in of pets and game animals
  • Smoking in the work area and inside the building;
  • Playing loud music
  • 3.11
    Unit Owner and/or the Contractor shall strictly observe the following fire protection and safety measures:
    3.11.1
    Provision by the Unit Owner/Contractor’s to provide a 10 lbs. ABC type fire extinguisher in the work area.

    There should be at least one (1) unit fire extinguisher.

    3.11.2
    Extra precautionary measures should be exercised in the handling and storage of inflammable construction materials.

    3.11.3
    Accomplishment of torching or welding work should have prior clearance from the Administration Office. An additional ABC or type D fire extinguisher shall be posted by the Contractor during accomplishment of hot work.

    3.11.4
    Units Owner and/or Contractor shall obtain permission from the Administration Office if there is a need to remove from service any fire protection or alarm systems.

    3.12
    Unit Owner and/or Contractor shall ensure that all windows, doors, faucets and other items that may cause damage to the unit are securely locked and closed. Unit owner and/or contractor shall be responsible for any damage in the unit and/or neighboring units caused by negligence by themselves or their workers. Leaning on the window panes and sitting on the window sills are strictly prohibited.
    3.13
    The sidewalks, entrances, passages, corridors, stairways, elevators, and other access areas of the building shall not be obstructed or used by the Contractor for any for any other purpose other than ingress to and egress from the building.
    3.14
    The contractor shall observe the following housekeeping and sanitary measures:
    3.14.1
    Contractor shall provide the necessary trash receptacles;

    3.14.2
    Proper disposal of garbage and construction debris is the Contractor’s responsibility and these must be hauled out of the complex at regular intervals. Hauling arrangements must be made with the Administration Office.

    Failure to do so shall compel the Administration Office to dispose of such garbage/debris at the Contractor’s expense;

    3.14.3
    The cost of garbage/debris hauling left and found in the common areas of the building and whose source can no longer be established shall be billed equally among all of the Contractors working in the building or in a specific area or floor.

    3.15
    Staging and stockpiling of construction materials and equipment must be confined to the unit’s area only. No stockpiling shall be allowed at lobbies/hallways and other places defined by Administration Office as common areas.
    3.16
    Materials, supplies and equipment delivery shall be made at the Ground Floor Parking using either Service Elevator or the Service Stairs.
    3.17
    Contractor / Unit Owner shall ensure ample protection to all existing building structures/facilities by providing temporary cover / shoring / bracing or supports. Any damage to these facilities during construction shall be repaired to their original condition or replaced by the Contractor/Unit Owner.
    3.18
    All building facilities and instrumentation (elevator, sprinklers, fire alarms, etc.) are not to be tampered, alerted, relocated or removed without the prior written approval of the Condominium Corporation.
    3.19
    Renovation/Construction work and workers shall be properly supervised by the Unit Owner/tenants or their representatives.

    The Unit Owner shall be held accountable for lost or damaged property if such loss or damage was caused directly or indirectly by the Unit Owners, Architect/Contractor, their representative or workmen involved in the project.
